DSE welcomes the European Commission plans to step up enforcement rules on Unfair Commercial Practices

On 14 March 2013 the European Commission published the final report on the implementation of the Unfair Commercial Practices Directive (2005/29/EC). The European Commission plans to review the guidelines adopted in 2009 for Member States to better interpret the Directive and assure its proper enforcement.

The UCPD was adopted in 2005 to boost consumer confidence in businesses and protect their rights. The UCPD identified 31 black-listed practices, describing the rules to identify misleading and aggressive unfair commercial practices. Since then, some Member States and relevant stakeholders have highlighted that lack of resources, complexity of national procedures and inefficient sanctions threaten to undermine the application of the legislation. 

DSE will work closely with the European Commission in the coming months in order to revise the guidelines and ensure a uniform implementation of the Directive across the EU.
